OSHA ETS Information

COVID-19 is still going strong. We are doing all that we can to ensure the safety of our employees, while trying to allow employees to support their families and serve our customers.

We want to update you on the OSHA Emergency Temporary Standard (ETS). On Friday, January 7, 2022, The US Supreme Court is hearing oral argument on whether the ETS will remain in effect. As of right now and until we know something different, we must comply with the ETS rules.

As you know, the ETS requires either a mandate of vaccination or masks and weekly testing for those unvaccinated; Muncie Power Products has chosen not to mandate vaccinations. Because of this, we must follow certain rules.

Effective January 9, 2022, employees who are unvaccinated (individuals who have not had two shots of the Moderna or Pfizer vaccination or one shot of the J&J vaccination more than two weeks ago) must wear a mask in the workplace, including, but not limited to, employees with an office, in vehicles with others, at company functions, visiting customers, or on company business while around others. Masks provided by Muncie Power Products, which are ETS approved, surgical, and tight-fitting are required. Gators, Muncie Power Products branded cloth masks, and other masks are not permitted.

Managers will be provided with a list of employees who are not vaccinated to ensure compliance and in order to comply with the ETS. Additionally, if you are unvaccinated and test positive, the ETS states you must quarantine for 10 days.

On February 9, 2022, employees who are unvaccinated must undergo weekly testing in order to come to work. We plan to have testing on site for the Pine Street Facility, the Pershing Facility, and the Muncie Facility. Muncie Power Products will provide the tests for employees or reimburse employees who are remote, who are in Sales, or who are working at the MDCs. More details will be provided as we finalize our plans. We will provide our additional written guidance and hold meetings.

Disciplinary action, up to and including termination, may be issued for employees who fail to abide by the mask and testing requirements.

If you have not provided your proof of vaccination to Human Resources, please do so immediately. In addition, your manager will be requiring you to complete a form verifying your vaccination status by Friday, January 7, 2022, end of day. If this form is not fully completed and you have not provided proof of vaccination to Human Resources, you will be treated as non-vaccinated.

Meetings are scheduled for All People Leaders with separate meetings planned for all employees. The sessions are listed in MPU as “OSHA ETS Meeting for All Managers” and “OSHA ETS Meeting for All Employees” (with the locations noted in the title line). Please sign up for the meeting according to your location and note that a Zoom option is available for each. For those who cannot attend, the Zoom meeting will be recorded; however, live participation is highly encouraged. All managers must attend one of the managers meetings and all employees must attend one of employee meetings.
